These General Terms and Conditions of Sale (GTC) govern the sale of art photographs offered by Laurence Baty, whose head office is located in Genappe, Belgium. Any order implies unconditional acceptance of these GTC.
The art photographs offered for sale are those featured on the website www.lbatyhorsephotography.com. Descriptions, dimensions, formats, and prices are indicated on each product page. The photographs are presented for illustrative purposes and may vary slightly.
The prices of our photographs are indicated in euros, inclusive of all taxes (TTC), excluding delivery costs. Prices may be changed at any time, but current orders will be invoiced based on the rates in effect at the time the order is confirmed.
Orders are placed online via the website https://lbhorsephotography.etsy.com or by email at l.baty79mail.com upon request for a quote. After selecting the photograph(s), the customer must follow the purchasing procedure, provide the necessary information, and confirm their order. Confirmation of the online order or email quote constitutes acceptance of the Terms and Conditions and constitutes a firm and definitive contract.
Payment is made online by credit card, PayPal, or bank transfer. The transaction is secure. Physical prints are shipped after receipt of full payment.
Physical prints are delivered by international mail to the address provided by the customer, within the timeframe indicated at the time of ordering.
In accordance with Belgian law, the customer has 14 calendar days from receipt to exercise their right of withdrawal, without having to provide a reason. Refunds will be issued within 14 days. Returns and exchanges are not permitted.
The photographs remain the exclusive property of the artist or the seller. Any unauthorized reproduction, use, or distribution constitutes a copyright violation and is strictly prohibited. The sale does not include the transfer of copyright, unless otherwise stated.
The seller cannot be held liable for any indirect or immaterial damages related to the use of the photographs. The seller's liability is limited to the amount of the order.
The personal data collected during the order is necessary for processing the order. In accordance with the GDPR, the customer has the right to access, rectify, delete, and object to the processing of their personal data. To exercise these rights, the customer may contact l.baty79mail.com.
These General Terms and Conditions are governed by Belgian law. In the event of a dispute, the customer may refer the matter to the competent court in Nivelles, Belgium.
The seller reserves the right to amend these General Terms and Conditions at any time. The applicable version is the one online at the time of the order.
